The rejection of the PP complicates the express reform of the PSOE to renew the Judicial and Constitutional Powers | Spain

The PSOE will register this Friday by the urgent procedure, and without having previously agreed with any group, its Proposal to reform an article, 570 bis, of the Organic Law of the Judiciary in order to facilitate the immediate renewal, before the summer, of the governing body of the judges and, through it, of the Constitutional Court. The Socialists justify this rush given the “impossibility” of closing a pact with the PP, now led by Alberto Núñez Feijóo, to renew these organizations. The popular leader has already advanced that he rejects this express change and that, he has announced, supposes a break in the negotiations, and has affirmed that what the Government intends is “to control the Constitutional Court”, a court that must immediately address several resources to laws of the highest relevance.

Núñez Feijóo has received this new reform promoted by the PSOE with tremendous anger and assures that he knew about it because of the dam, after advancing it on Thursday night eldiario.es there confirm it EL PAÍS. The popular leader considers that this movement of the socialists “breaks any type of bridge to continue negotiating” the renewal of the General Council of the Judiciary. “We have the feeling that the Government does not want to negotiate anything,” he said in an interview on Telecinco. The PP, with whom the PSOE had opened talks to renew the governing body of the judges, rejects the legal initiative: “How are we going to support a change in which the Government seems to no longer be interested in negotiating the Judiciary? ”, Feijóo has inquired.

The popular had promised to send the Government a proposal on the Council of the Judiciary within a month after the elections and the light of 19-J, and sources from the PP leadership assured that this coming week they would have already prepared that document. Let us remember that the Executive has not answered them nor has it been able to offer a pact under NATO nor has it known an economic plan to lower taxes.

The conversations between Félix Bolaños, Minister of the Presidency, and Esteban González Pons, Institutional and Justice Deputy Secretary of the PP, were interrupted during the electoral campaign and there were several frustrated attempts before with the popular leadership that incriminated Pablo Casado. But the official sources of the PP assure that González Pons did not know that reform promoted now by the Government. That movement leaves a wound and complicates the road even more, according to the PP. The modification of an organic law such as that of the Judiciary requires the absolute majority of Congress: the PSOE will have to seek it, therefore, in its usual partners in Parliament, who have not yet pronounced.

The PSOE reform proposal involves partially disrupting or reforming the provision that the PSOE reformer promoted and approved a year ago: prohibiting the Judiciary from appointing judges while they are in office. That reformed has kept the CGPJ tied hand and foot during the last year, which has led to a pre-collapse situation (as reported by the Judiciary itself) in some rooms of the Supreme Court, the most affected court. Now, the new express reform of the Socialists would imply maintaining that prohibition on making appointments, except in one case: the appointment of magistrates for the Constitutional Court, which the PSOE wants to renew immediately.

The spokesman for the PSOE in Congress, Héctor Gómez, explained this Friday the reason for the initiative: “Faced with the impossibility of reaching an agreement with the PP because the PP does not abide by the constitutional mandate of renewing the General Council of the Judiciary, which already affects the renewal of the Constitutional Court, we opted for this proposal to be able to unblock it as soon as possible and that it can appoint the two magistrates of the Constitutional Court and have a correct performance of their functions”. Minister Félix Bolaños has stated that the proposal is legally “impeccable” and that no one should oppose it.

The PSOE will register this Friday the proposal by the urgent procedure, with the idea that now it will enable an extraordinary plenary session of Congress in July, it will be sent with express procedure to the Senate and it will be published and enter into force as soon as possible, if possible before Summer Vacation.

The position of United We Can

The Socialists have only given their intention to their partner in the coalition, United We Can, but Gómez said that he hopes to add more support: Constitutional”, he said. United Sources We Can affirm that they must know in detail the proposal signed only by the socialists but that their position, in principle, is that all constitutional positions must be completely renewed, not just a part.

Vox’s parliamentary spokesman, Iván Espinosa de los Monteros, has also been very harsh against the Government, whom he has branded as “totalitarian” and has accused of “not believing in institutions.” “He is an autocrat who wants to control everything,” said President Pedro Sánchez.

The socialist spokesman repeatedly pointed to the responsibility of the main opposition party. Gómez summoned the PP to “once and for all they felt to negotiate and renew the Judicial Power after three years of bloco”. The socialist sector of the Government maintains that this action by its parliamentary group when registering the proposal unilaterally should not distance the pact with the PP. “On the contrary, what we want is to give normality to the functioning of the judicial sphere, in this case the Constitutional, and it is an exercise of maximum responsibility,” Gómez emphasized. And he added: “We can’t keep waiting sine die by the PP and that the operation of the courts in this country and in this case the Constitutional Court be in their hands and in their will”.
